Subject
Resolution -
WHEREAS, any official position of the City of Los
Angeles with respect to litigation, rules regulations, or policies
proposed to or pending before a local, state or federal government
body or agency must have first been adopted in the form of a
Resolution by the City Council with the concurrence of the Mayor;
and
WHEREAS, the City of Los Angeles fully supports legislation that
enhances the ability of law enforcement to provide a sense of security
and responsibility for residents of the City of Los Angeles; and
WHEREAS, illegal street racing has become a serious problem in
the San Fernando Valley and other areas of the City, causing untimely
deaths and serious injuries to participants and bystanders and
has diminished the quality of life surrounding neighborhoods; and
WHEREAS, current law provides that any person who drives any vehicle
upon a highway or off-street parking facility in a willful disregard
is reckless driving; and
WHEREAS, existing law provides that no person shall engage in any
motor vehicle speed contest which includes a motor vehicle racing
against another vehicle, a time clock, or other timing device;
and
WHEREAS, under existing law when a person is arrested for a speed
contest the officer may impound the vehicle for not more than 30
days; and
WHEREAS, SB 1489 (Perata) would allow for the impoundment of vehicles
used in reckless driving or exhibition or speed violations; and
WHEREAS, SB 1489 is on the Governor's desk awaiting signature;
and
WHEREAS, this bill would take effect immediately as an urgency
statute.
NOW THEREFORE,
BE IT RESOLVED that the Council determine, as provided
in Section 54954.2(b)(2) of the Government Code, and pursuant to
Rule 23 of the Rules of the City Council, that there is a need
to take immediate action on this matter and that the need for action
came to the attention of the City Council subsequent to the posting
of the agenda for today's Council meeting; and
BE IT FURTHER
RESOLVED, with the concurrence of the Mayor, that
by the adoption of this Resolution, the City of Los Angeles, SUPPORTS
SB 1489 (Perata) and other similar legislation that would allow
for the impoundment of vehicles used in reckless driving or exhibition
or speed violations.
